Welcome to the Hale/Class 1 3D Model Catalog Site ("Site"), a website maintained by Hale/Class 1.
This Site is provided as a service to Hale/Class 1 business partners to provide Tools to aid them in selling and using Hale/Class 1 products.
Access to the Site will be granted to only to Users who Hale/Class 1 authorizes to use this Site and accept the provisions of the following Privacy Policy and the following License Agreement. Acceptance is indicated by clicking the “I Accept” button below the text box on the initial review screen. Unless you agree with all of the provisions of the following Privacy Policy and the following License Agreement, you should not click the “I Accept” button. When you click the “I Accept” button, you will be agreeing on behalf of yourself and the Hale/Class 1 business partner that employs you to be subject to and bound by and comply with all of the provisions of the following Privacy Policy and the following License Agreement. When you click the “I Accept” button, you will also be warranting and representing on behalf of yourself and the Hale/Class 1 business partner that employs you that the information you provided in gaining access to this Site is and will remain accurate, and complete unless and until you advise Hale/Class 1 otherwise in writing.
The terms “Hale/Class 1”, “Company”, “we”, “our” and “us” refer to and include Hale Products, Inc. and Class 1, Inc.; the terms “User”, “Users”, “you” and “your” refer to and include Hale/Class 1 business partners and their employees; and the term “Tools” refers to the Hale/Class 1 3D Model Catalog made available to Users on this Site.
Privacy Policy
This Privacy Policy sets forth our information gathering and dissemination practices for this Site. Because the Company gathers information about Users on this Site, we believe you should understand how the Company intends to treat any personally identifiable information Users may provide. Personally identifiable information is information that can identify the User, including, but not limited to, your name, email address, street address, telephone number, employer and occupational title.

In order to use this Site, you must have valid credentials: a Username and a password. To obtain these credentials, you must submit some personal information to the Company, including, but not limited to, your name, email address, business street address, business phone number, and employer name. The Company uses this User-profile data primarily to ensure that you are a person that Hale/Class 1 has authorized to use this Site and that the correct business rules and logic as well as security measures are invoked for your User session. Forms
Forms are used on this Site to collect information from you, which will allow us to carry out a number of tasks, including, but not limited to responding to User password resets or technical feedback. Any personal information collected is intended to be used only for analysis or follow-up purposes. In order to effectively respond to and support certain User requests, Hale/Class 1 may share your information with support staff, your employer, or outside support staff where necessary to isolate and/or resolve technical issues.
Log Files
Like most standard website servers, this Site's web servers generate log files that store non-personal information about your visit to this Site. The information collected includes, but is not limited to, length of time of visit, pages visited, number of visits, IP address, Internet service provider, referring/exit pages, and platform type (IP addresses, etc., are not tied to personally identifiable information). License Agreement
This License Agreement sets forth the terms and conditions under which Tools are licensed for use and made available to Users.
- Nothing in this License Agreement or otherw ise shall be deemed to require Hale/Class 1 to provide or make available any particular Tool to any User.
- Tools (a) are and shall at all times remain the confidential information of, proprietary to, and the exclusive property of Hale/Class 1, (b) must at all times be treated, protected and secured by Users as the confidential information of, proprietary to, and the exclusive property of Hale/Class 1, (c) may be used by Users only for the purpose of marketing and selling Hale/Class 1 products and services and for no other purpose, (d) must at all times be utilized by Users only as permitted by U.S. Export Administration Regulations and U.S. Department of the Treasury embargo regulations, and (e) except as may be authorized in writing by Hale/Class 1, cannot at any time be copied or duplicated. Users are required to protect against unauthorized access to and use of Tools by passwords and other appropriate security measures. Users are prohibited from removing or modifying any copyright or other similar notice on any Tool showing Hale/Class 1 to be the owner thereof, and, if and whenever any Tool is copied or duplicated, all copyright and other similar notices thereon showing Hale/Class 1 to be the owner thereof shall also be copied and duplicated.
- ALL TOOLS ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR ANY WARRANTY THAT THE TOOLS ARE OR WILL BE ERROR-FREE. Users assume all risks and liabilities associated with their use of any Tool.
- If any Tool involves or requires the use of third-party software (e.g., Microsoft Excel), Hale/Class 1 will identify the software and minimum supported version required. Users will be responsible for obtaining at their own cost and expense all licenses necessary for them to use such third-party software, and Users shall not use any Tool that involves or requires the use of third-party software unless and until all such licenses have been legally obtained and are in effect.
- Tools and related technical information, data, documents and materials are subject to export controls under U.S. Export Administration Regulations and U.S. Department of the Treasury embargo regulations. Users must strictly comply with all such export controls, must fully cooperate with Hale/Class 1 in any official or unofficial investigation, audit or inspection that relates to any of such controls, and cannot export, re-export, divert or transfer, directly or indirectly, any Tool or any related technical information, data, documents or materials to any party or destination or for any use that is subject to an embargo or otherwise prohibited pursuant to such controls, unless and until all required U.S. governmental and regulatory approvals, authorizations, licenses and permits are obtained.
- The right and license of a User to use all Tools shall automatically terminate if such User at any time makes any unauthorized disclosure, dissemination or use of any Tool. Unauthorized disclosure, dissemination or use of any Tool by any employee of any Hale/Class 1 business partner shall result in termination of the right and license of such Hale/Class 1 business partner and all of its employees as to all Tools, In addition, Hale/Class 1 shall have the right to terminate the right and license of any User to use any or all Tools at any time. If and whenever the right and license of a User to use a Tool terminates, the User shall immediately cease all use of such Tool and immediately return to Hale/Class 1 or destroy all copies of such Tool if applicable.
- Each User shall defend, indemnify and hold harmless Hale/Class 1 from and against any and all claims, actions, suits, investigations, liabilities, losses, damages, costs and expenses (including, but not limited to, attorneys fees and other legal expenses and judgments, fines, penalties and settlements in connection with any such claim, action, suit or investigation) arising out or attributable to any breach of this License Agreement by such User (including, but not limited to, any unauthorized disclosure, dissemination or use of any Tool by the User). Breach of this License Agreement by any employee of a Hale/Class 1 business partner shall also constitute a breach of this License Agreement by such Hale/Class 1 business partner and shall require that such Hale/Class 1 business partner defend, indemnify and hold harmless Hale/Class 1 pursuant to this Paragraph 7 with respect to such breach.
- Each User acknowledges and agrees that any actual or threatened unauthorized disclosure, dissemination or use of any Tool by such User will cause Hale/Class 1 irreparable harm for which Hale/Class 1’s damages cannot be readily determined and/or for which Hale/Class 1 cannot be adequately and fully compensated by recovery of damages alone, and Hale/Class 1 shall be entitled, in addition to any and all other remedies and relief available to it, to injunctive or other equitable relief to prevent or remedy such actual or threatened unauthorized disclosure, dissemination or use, without any requirement that Hale/Class 1 demonstrate irreparable harm or post any bond or other security.
- Hale/Class 1 shall be entitled to recover from each User all costs and expenses (including, but not limited to, attorneys fees and other legal expenses) in connection with enforcing this License Agreement against such User. Enforcement of this License Agreement against an employee of a Hale/Class 1 business partner shall also constitute enforcement of this License Agreement against such Hale/Class 1 business partner and shall entitle Hale/Class 1 to recover its costs and expenses from such Hale/Class 1 business partner pursuant to this Paragraph 9.
- This License Agreement sets forth the entire agreement and understanding of Hale/Class 1 and all Users concerning terms and conditions under which Tools will be licensed and made available to and may be used by any User, and supersedes any and all prior agreements and understandings, oral and written, relating to the terms and conditions under which Tools will be licensed and made available to and may be used by any User. Hale/Class 1 reserves the right to change, modify, add, or remove portions of this License Agreement at any time, for any reason, and without notice. Compliance with the provisions of this License Agreement may be waived only in writing signed by Hale/Class 1. This License Agreement shall be binding upon and enforceable against all Users and inure to the benefit of and be enforceable by Hale/Class 1 and each of its subsidiaries and their respective successors and assigns. This License Agreement shall be governed by and interpreted in accordance with, and the rights, liabilities and obligations of Hale/Class 1 and all Users in connection with this License Agreement shall be determined under and in accordance with, the laws of the United States of America and the State of Delaware. By clicking on the “I Accept” below the text box on the initial review screen, each User (when clicked on by an employee of a Hale/Class 1 business partner, both such employee and such Hale/Class 1 business partner) irrevocably (i) consents to the jurisdiction and venue of the federal and state courts in the State of Delaware for any action to enforce this License Agreement against such User, (ii) waive any objection to any such court based on forum non-conveniens or otherwise, and (iii) agrees that all decisions and rulings of such courts shall be binding upon such User and may be fully enforced against such User in any jurisdiction, whether within or outside the State of Delaware.
